Before you proceed to purchase tickets, we strongly recommend you go through the following BUSFEST TICKETING TERMS & CONDITIONS

In this section, words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to you -the person who will buy the tickets to BUSFEST On the other hand, ‘our’, ‘us’,‘we’, ‘issuer’, ‘provider’ and similar terms will indicate the organisers of BUSFEST & VANFEST LIMITED.

“Event” means BUSFEST. “Promoter” BUSFEST.

“Terms and Conditions” means these terms and conditions.

“Ticket “ A valid ticket/QR Code or wristband which permits you to attend the

Event or any valid wristband for which you have exchanged your valid ticket at the Event.

“You” means you as the holder of the Ticket and “Your” shall be read accordingly.

By opting to purchase, allocate or possess tickets to BUSFEST you automatically agree to our terms of use. If you have problems with any of the clauses listed below or do not agree with the risk allocations mentioned here, please do not purchase tickets to enter the BUSFEST event.

Please note that BUSFEST reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions, without any prior notifications to you. Such changes will be duly reflected on the website of the organiser WWW.BUSFEST.ORG . These

changes will relate back to the date of purchase of BUSFEST tickets.

Introduction

We are BUSFEST (Trading as VANFEST Limited/T/A Busfest) of Wessington

House, 2 Milton Lane, Steventon, OX13 6SA.

Personal data collected by BUSFEST.

Data we automatically collect.

When you visit our event website & ticketing page, we, or third parties on our behalf,

automatically collect and store information about your device and your activities.

This information could include;

(a) your computer or other device’s unique ID number;

(b) technical information about your device such as type of device, web browser or

operating system.

(c) your preferences and settings such as time zone and language.

(d) statistical data about your browsing actions and patterns.

We collect this information using cookies in accordance with the Cookie section of this policy and we use the information we collect on an anonymous basis to improve our event website & ticketing system, our events and the products and services we provide, and for analytical and research purposes.

Marketing Communications

It may be necessary for our legitimate interests to use your personal data to send you marketing communications, which may include newsletters, blog posts, surveys and information about new events.

If you do unsubscribe to marketing communications, it may take up to 5 business days for your new preferences to take effect. We shall therefore retain your personal data in our records for marketing purposes until you notify us that you no longer wish to receive marketing emails from us.

Lawful processing of your personal data

We will use your personal data in order to comply with our contractual obligation to

supply to you;

We may also use your personal data for our legitimate interests, including dealing with any customer services you require, enforcing the terms of any other agreement between us, for regulatory and legal purposes (for example anti-money laundering), for audit purposes and to contact you about changes to this policy.

Who do we share your data with?

We may share your personal data with any service providers, sub-contractors and agents that we may appoint to perform functions on our behalf and in accordance with our instructions, including payment providers, event ticketing providers, email communication providers, IT service providers, accountants, auditors and lawyers.

Under certain circumstances we may have to disclose your personal data under applicable laws and/or regulations, for example, as part of anti-money laundering processes or protect a third party’s rights, property, or safety.

We may also share your personal data in connection with, or during negotiations of, any merger, sale of assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

Where we hold and process your personal data

Your personal data may be stored or transferred outside of the UK and the European Union (the EU) for any reason, including for example, if our email server is located in a country outside the UK or EU or if any of our service providers or their servers are based outside of the UK or EU.

We shall only transfer your personal data to organisations that have provided adequate safeguards in respect of your personal data.

Cookies

A cookie is a small text file containing a unique identification number that is transferred (through your browser) from a website to the hard drive of your computer.

The cookie identifies your browser but will not let a website know your name and/or address. These files are then used by websites to identify when users revisit that website.

Our event ticketing system uses cookies so that we can recognise you when you return and personalise your settings and preferences.

Most browsers are initially set up to accept cookies. You can change your browser settings either to notify you when you have received a cookie, or to refuse to accept cookies. Please note that our event ticketing system shop may not operate efficiently if you refuse to accept cookies.

We may (in the future) also use Google Analytics to monitor how the event website & ticketing page are used. Google Analytics collects information anonymously and generates reports detailing information such as the number of visits to the event webpage ticketing page, where visitors generally came from, how long they stayed on the event ticket shop, and which pages they visited. Google Analytics places several persistent cookies on your computer’s hard drive.

If you do not agree to this, you can disable persistent cookies in your browser. This will prevent Google Analytics from logging your visits.

Data Security

We shall process your personal data in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organisational measures.

However, we acknowledge that no system can be completely secure. Therefore, although we take these steps to secure your personal data, we cannot guarantee that your personal data will always remain completely secure.

Your rights

You have the right to obtain from us a copy of the personal data that we hold for you, and to require us to correct errors in the personal data if it is inaccurate or incomplete.

Our event website may contain links to other sites of interest. Once you have used these links to leave our website, you should note that we do not have any control over that other site. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this policy. You should exercise caution and look at the privacy policy applicable to the site in question.

Data Retention

General

If any provision of this policy is held by a court of competent jurisdiction to be invalid

or unenforceable, then such provision shall be construed, as nearly as possible, to

reflect the intentions of the parties and all other provisions shall remain in full force

and effect.

OTHER LEGAL STUFF

Except to the extent that the Promoter is required or permitted by law, personal information provided by You to the Promoter will be used for all purposes reasonably connected with the operations of the Event including (but not limited to):

Providing You with details of forthcoming connected events, offers and services; providing You with updates as to the latest concessions or any changes thereto and information concerning competitions and other promotional activity; supplying You with the goods that You request; conducting market research and establishing customer profiles; and transferring or disclosing the information provided to the Promoter’s professional advisors and such other parties as it considers necessary in the administration of its business.

You agree that the Promoter, its servants or agents will not be liable for any loss, injury or damage to any person (including Yourself) or property however caused (including by the Promoter or its servants or agents): (a) in any circumstances where there is no breach of a legal duty of care owed by the Promoter or any of its servants or agents; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury as a result of a breach of a legal duty of care owed by the Promoter, its servants or agents); or (c) to the extent that any increase in any loss or damage results from breach by You of any of these Terms and Conditions.

For the purposes of these Terms and Conditions, “Force Majeure” means any cause beyond Promoter’s control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local governments.

The Promoter will not be liable to You for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure.

To the fullest extent permissible in law, the Promoter shall be entitled to assign all and any of its rights and obligations under these Terms and Conditions, provided that Your rights are not adversely affected.

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of these Terms and Conditions valid or enforceable.

If the Promoter delays or fails to enforce any of these Terms and Conditions, it shall not mean that the Promoter has waived its right to do so.

Any person, other than the Promoter, who is not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions. Nothing in these Terms and Conditions and no action taken by You or the Promoter under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other fiduciary relationship between You and the Promoter.

These Terms and Conditions constitute the entire agreement between the parties in connection to the subject matter of these Terms and Conditions and supersede any previous terms and conditions, agreement or arrangement between You and the Promoter relating to the subject matter of these Terms and Conditions. However, nothing in these Terms and Conditions shall purport to exclude liability for fraud or fraudulent misrepresentation.

These Terms and Conditions cannot be varied or amended in any respect (unless agreed between You and the Promoter in writing).

The Possession of a Ticket shall constitute an acceptance by the holder of the terms & Conditions and an undertaking on the part of the holder to accept them.

These Terms and Conditions shall be governed by the laws of England and Wales and parties agree to submit to the exclusive jurisdiction of the English Courts.

The Promoters reserve the right to amend the Terms & Conditions in accordance with any new law, legislation or internal Showground or Event Organizers policies.
